MAYOR SMALL OPENED THE MEETING OF THE BOARD OF WORKS AND SAFETY.

THE PLEDGE OF ALLEGIANCE WAS GIVEN BY ALL IN ATTENDANCE.

PRAYER WAS GIVEN BY DAN DENNY.

 

DIRECTOR DAVIS MOVED TO APPROVE ALL CLAIMS, PAYROLL, CITY AND UTILITIES DATED AUGUST 31RD TO SEPTEMBER 7TH..

DIRECTOR DAVIS ANNOUNCED THE HOME OWNER REPAIR GRANT BID OPENING WAS TO BE.

ATTORNEY COPENHAVER MADE THE MOTION TO TAKE THE BIDS UNDER ADVISEMENT.

DIRECTOR DAVIS SAID NEXT ON THE AGENDA WAS AN ASCAP LICENSE AGREEMENT.  SHE SAID IT STANDS FOR AMERICAN SOCIETY OF COMPOSERS, AUTHORS AND PUBLISHERS.   MEMBERSHIP FOR ONE YEAR COST $305.00.

DIRECTOR DAVIS MADE THE MOTION TO PAY THE FEE.   ATTORNEY COPENHAVER: SECOND      MAYOR SMALL: AYE      AYE VOTE: 3-0

 

DIRECTOR DAVIS PRESENTED THE KEYSTONE ANNUAL SOFTWARE MAINTENANCE AGREEMENT

(NOV. 1, 2010 TO NOV. 1, 2011) AND THE SOFTWARE LICENSE (KEY LEDGER FOR WINDOWS).

DIRECTOR DAVIS MOVED TO MOVE FORWARD WITH THIS ANNUAL CONTRACT.   ATTORNEY COPENHAVER: SECOND     MAYOR SMALL: AYE          AYE VOTE: 3-0

 

DIRECTOR DAVIS REQUESTED THAT CERTAIN STREETS BE CLOSED FOR THE OKTOBERFEST RIBFEST ON OCT. 16TH FROM 7:30 A.M. TO 9:00 P.M.

DIRECTOR DAVIS MADE THIS REQUEST AS A MOTION.    ATTORNEY COPENHAVER: SECOND    MAYOR SMALL: AYE    AYE VOTE: 3-0

 

 

DIRECTOR DAVIS MADE THE MOTION TO RATIFY THE PAY OUT APPLICATION #1 FROM PRITCHETT'S FOR $60,742.53 AS REVIEWED AS SUFFICIENT BY UNITED CONSULTING FOR THE BLUE RIVER VALLEY ANNEXATION AREA SANITARY SEWER AND WATER EXTENSION PROJECT, PHASE III.

DIRECTOR DAVIS MADE THE MOTION THAT WE ACCEPT A DOCUMENT PREPARED BY THE CITY'S H R, A POLICY THAT ALLOWS THAT ALLOWS MANAGEMENT TO SELL UP TO 30 DAYS OF THEIR ACCUMULATED SICK/VACATION DAYS WHILE ACTIVELY EMPLOYED.

      ATTORNEY COPENHAVER SAID THIS USE HAS TO BE APPROVED BY THE MAYOR.

      H R VAN ARSDOL SAID YES.

ATTORNEY COPENHAVER SAID WITH THE STIPULATION, APPROVAL AND FUNDING HE SECOND THE MOTION.   MAYOR SMALL: AYE VOTE.   AYE VOTE: 3-0

 

DIRECTOR DAVIS MADE THE MOTION TO ACCEPT THE ROAD CLOSURES REQUESTED BY S & D CONTRACTORS FOR THE MAXWELL COMMONS.  THEY WILL BE DEMOLISHING THE BACK OF THE PENNEY'S BUILDING DURING THE MONTH OF SEPTEMBER.  THIS WILL BE FOR A SAFETY MEASURE. THE ROAD (FLEMING STREET) IS DIRECTLY BEHIND THE BUILDING.  ALL EMERGENCY SERVICES HAVE BEEN NOTIFIED.  THE PARKING SPACES IN FRONT OF THE BUILDING WILL ALSO BE CLOSED.   ATTORNEY COPENHAVER: SECOND   MAYOR SMALL: AYE    AYE VOTE: 3-0

 

DIRECTOR DAVIS MADE THE MOTION TO CLOSE STATE ROAD #38, MAIN STREET FROM BROAD TO RACE STREET.  A PERMIT FROM THE STATE HAS BEEN RECEIVED.  THIS CLOSURE IS FOR THE 2ND ANNUAL BOBBY GOODWIN MEMORIAL CAR SHOW, SEPTEMBER 11TH FROM 3:00 P.M. TO 7:00P.M..

THE CLOSURE WILL ALSO INCLUDE A BLOCK PART FOR YAPA.    ATTORNEY COPENHAVER: SECOND     MAYOR SMALL: AYE     AYE VOTE: 3-0

 

 

DIRECTOR DAVIS MADE THE MOTION TO ACCEPT THE LOWEST, MOST RESPONSIVE, RESPONSIBLE QUOTE FOR APPRAISALS FOR COMPLETED NSP PROPERTIES FROM BRIAN T. JACKSON.  EACH HOME APPRAISAL WILL COST $270.00; EACH CONDO APPRAISAL WILL BE $290.00 FOR A COMBINED TOTAL OF $1,970.00.  THIS MONEY COMES OUT OF THE NSP GRANT.   ATTORNEY COPENHAVER: SECOND    MAYOR SMALL: AYE    AYE VOTE: 3-0

 

DIRECTOR DAVIS SAID SHE HAD 5 CHANGE ORDERS FOR THE MAXWELL COMMONS.  COLLECTIVELY, IT AMOUNTS TO $28,000.00 REDUCTION TO THE HOMES AND AN INCREASE OF $40,447.06 TO THE CONDOMINIUMS.  DIRECTOR DAVIS MADE THIS A MOTION TO ACCEPT THESE CHANGE ORDERS.

MAYOR SMALL ANNOUNCED THAT A WAIVER OF PERMIT FEES ASSOCIATED WITH UNITED FUND DAY OF CARING PROJECTS.  HE SAID THE LIST MUST BE RECEIVED BY WEDNESDAY, SEPTEMBER 8TH, AS DAY OF CARING IS SCHEDULED FOR FRIDAY, SEPTEMBER 10TH.  THIS IS A GOODWILL THAT THE CITY IS OFFERING TOW2ARD THIS PROJECT.   MAYOR SMALL SAID THIS ANNOUNCEMENT IS A MOTION.  ATTORNEY COPENHAVER: SECOND     DIRECTOR DAVIS: AYE     AYE VOTE: 3-0

 

DEPARTMENT HEADS;

EMS DIRECTOR RON BURNS SAID HE HAD FOUND A BUYER FOR THE 2 OLD AMBULANCES.  HE SAID HE WAS GOING TO TRADE THEM IN ON THE NEW ONES BUT WAS ONLY GETTING $8,000.00.  WITH THE NEW BUYER, THE SALE WILL BE FOR $18,000.00.

 

DIRECTOR DAIVS SAID SHE HAD A CALL FROM DAVE NANTZ, HE WAS UPSET BECAUSE THE DUMPSTERS THAT ARE NOW LOCATED BEHIND HIS BUSINESS FOR THREE RIVERS ARE OVER FLOWING.  PEOPLE ARE DUMPING TRASH IN THE DUMPSTERS.  ATTORNEY COPENHAVER SAID WE WILL HAVE TO NOTIFY THREE RIVERS.

 

MAYOR SMALL SAID SPEAKING OF AUTOMATION, WE HAD A VISITOR FROM WORKMEN"S COMP AND ASKED WHY OUR CLAIMS HAD DROPPED ON WORKMENS COMP..  HE WAS TOLD IT WAS BECAUSE WE WENT TO AUTOMATED TRASH COLLECTION.  NOT ONLY IS AUTOMATION SAVING MONEY, PERHAPS SAVING SOME LIVES.

 

CITIZENS:

PAUL GILLOCK, 2700 LYNNDALE DRIVE.  HE WANTED TO KNOW WHAT THE CITY HAD DECIDED ABOUT THE WATER DRAINAGE ISSUE ON HIS PROPERTY AND NOW THE SMELL IS HORRIBLE.

     RANDY HAMILTON, HAMILTON CONSULTING, SAID THE CITY HAD DONE WORK ON HIS SEWER LINES AND WAS GOING TO PUT UP CEMENT BLOCKS TO SLOW DOWN THE WATER FLOW.

     MR. GILLOCK SAID HE HAD GOTTEN AN ESTIMATE FROM AN ENGINEER AND IT WOULD COST ABOUT $100,000.00 TO DO THE SYSTEM LIKE IT SHOULD BE DONE.  HE WANTED TO KNOW WHY THE STORM WATER MONIES COULDN'T BE USED TO DO THE CORRECTION.

     ATTORNEY COPENHAVER SAID BECAUSE OF THE DRY WEATHER, THERE IS A TERRIBLE SMELL.  THIS IS FROM THE COMBINED SYSTEM AND IN THE DRY WEATHER, THEY SMELL WORSE.   HE SAID HE HOPED WITHIN THE NEXT 15 YEARS, THE PLANS APPROVED BY EPA, WE CAN ELIMINATE A LOT OF IT.

     MR. GILLOCK WANTED TO KNOW IF THEY HAD TAKEN ANY BIDS TO HAVE LARGER DRAINS PUT IN.  WE HAVE DISCUSSED THIS BEFORE THAT THE DRAIN SYSTEM IS NOT LARGE ENOUGH TO HANDLE THE AMOUNT OF WATER THAT COMES ON HIS PROPERTY.

     MR. HAMILTON SAID THAT OUR ENGINEERING FIRM LOOKED AT IT AND SAID THERE WASN'T ANYTHING THAT COULD BE DONE IMMEDIATELY.  THAT IS WHY WE WENT AHEAD WITH THE OTHER DRAIN.

     MR. GILLOCK ASKED ABOUT THE $6.00 CHARGE, WHY COULDN'T THAT BE USED.

     ATTORNEY COPENHAVER SAID THAT $6.00 GOES TO PAY FOR A PLAN WHICH HAS BEEN DEVELOPED TO SEPARATE OUR STORM AND SANITARY SEWERS.  THAT IS TO PROVIDE THE MOST BENEFIT TO ALL THE CITIZENS, TO SEPARATE THOSE SYSTEMS.  IT IS NOT TO DRAIN CERTAIN AREAS.  HE SAID HE DIDN'T KNOW WHAT WAS IN THE PLAN BUT IF MR. GILLOCK WANTED TO SUBMIT HIS PLANS, 

     MR. HAMILTON SAID WE CAN'T SPEND THE MONEY ON INDIVIDUAL PROBLEMS UNLESS IT IS PART OF THE PLAN FOR HELPING TO TAKE THE WATER OFF TO PREVENT THE OVERFLOWS.  YOUR PROBLEM WOULD HAVE TO BE A SEPARATE SYSTEM.

     MR. GILLOCK SAID THAT IS WHAT THE ENGINEER TOLD HIM.  THE SEPARATE DRAIN WOULD RUN ON THE NORTH SIDE OF HIS HOUSE TO THE LYNNDALE OVERFLOW THAT LEADS TO BLUE RIVER.  MR. HAMILTON SAID THERE WAS A BIG DRAIN THAT THE STATE PUT IN.  WE CAN'T ADD TO THAT WITHOUT THE STATE'S APPROVAL.

     ATTORNEY COPENHAVER SAID IF YOU WANT TO GET A COPY OF THE PLANS OR PROPOSALS AND YOU WANT TO GIVE THEM TO US TO TAKE A LOOK AT IT, WE'LL BE GLAD TO DO THAT.  WE WOULD HAVE OUR ENGINEERS TAKE A LOOK.   ATTORNEY COPENHAVER TOLD MR. GILLOCK THAT THE CITY HAS DONE WORK THERE SINCE THE LAST RAINS AND HE HOPE THAT WOULD ALLEVIATE IT.

      MR. HAMILTON SAID WHEN THE WHEN THE STATE REMOVED ALL THE BRUSH IS WHEN THE WATER CAME FASTER.  THAT IS WHY I AM GOING TO PUT UP CONCRETE SLABS TO SLOW THE FLOW AND GIVE IT TIME TO GET INTO THE DRAINS.
