Board of Works Meeting Minutes - 8/2/2010

BOARD OF WORKS      

AUGUST 2, 2010        10:00 A.M.

 

MAYOR SMALL OPENED THE MEETING OF THE BOARD OF WORKS AND SAFETY.

THE PLEDGE OF ALLEGIANCE WAS GIVEN BY ALL IN ATTENDANCE.

PRAYER WAS GIVEN BY DAN DENNY.

 

DIRECTOR DAVIS MOVED TO APPROVE ALL CLAIMS, PAYROLL, CITY AND UTILITIES DATED JULY 26TH TO AUGUST 2ND.

ATTORNEY COPENHAVER: SECOND         MAYOR SMALL: AYE.              AYE VOTE: 3-0

 

DIRECTOR DAVIS SAID THE NEXT ON THE AGENDA WAS THE NEW ROAD CONSTRUCTION PLANS FOR THE GARNER STREET PROJECT.

     DIRECTOR DAVIS MADE THE MOTION TO APPROVE THOSE PLANS EFFECTIVE AS OF THIS DATE, AUGUST 2, 2010.

DIRECTOR DAVIS SAID THE NEXT ITEM WAS THE BID OPENING FOR 1615 INDIANA AVENUE.  SHE SAID THE BOARD HAD RECEIVED ONE BID AT 9:27 A.M., DATED AUGUST 2, 2010.  THE BID WAS FROM CINERGY METRO NET IN THE AMOUNT OF $22,150.00.

     ATTORNEY COPENHAVER ASKED IF THIS WAS MORE THAN THE MINIMUM BID THAT WAS ADVERTISED.

DIRECTOR DAVIS SAID THE MINIMUM BID WAS FOR $22,000.00.

     FOR THE RECORD:  THERE WERE NO OTHER BIDS.  ATTORNEY COPENHAVER ASKED IF THERE WAS ANYONE ELSE HERE IN THE AUDIENCE THAT WISHES TO SUBMIT A BID FOR THIS PROPERTY.  THERE WAS NO ONE.

      ATTORNEY COPENHAVER MOVED TO ACCEPT THE BID OF CINERGY METRO NET.    DIRRECTOR DAVIS: SECOND                      MAYOR SMALL: AYE                    AYE VOTE: 3-0

 

 

MAYOR SMALL SAID THE RECENT ORDINANCE THAT WAS PASSED, ESTABLISHING THE TRASH FEE OF $12.00 PER RESIDENCE, PER PROPERTY OWNER, INSTRUCTED THE BOARD OF WORKS TO ESTABLISH THE FEE, RENTAL CHARGES FOR ADDITIONAL TOTERS.  THE ORDINANCE PROVIDES EACH PROPERTY OWNER A 96 GALLON TOTER AND A 48 GALLON TOTER AS PART OF THE $12.00 A MONTH FEE.  WE HAVE A NUMBER OF MULTI-UNIT RESIDENTS, APARTMENTS, NON-PROFIT ORGANIZATIONS THAT REQUIRE MORE THAN ONE TOTER, MORE THAN TWO TOTERS.  THEREFORE, HE WANTED TO MAKE THE FOLLOWING MOTION.

      MAYOR SMALL READ HIS MOTION.  IN ACCORDANCE WITH  SECTION III A OF THE CITY OF NEW CASTLE ORDINANCE #3583, THE BOARD OF PUBLIC WORKS HEREBY ESTABLISHES A RENTAL FEE OF $6.00 PER MONTH FOR ADDITIONAL 96 GALLON TRASH TOTERS BEYOND THE (1) 96 GALLON TOTER PER PROPERTY THAT IS PROVIDED BY THIS ORDINANCE. (NOTE: ONE 48 GALLON TOTER CAN BE PROVIDED AT NO CHARGE, IN ADDITION TO AN INITIAL 96 GALLON TOTER, IF REQUESTED BY THE PROPERTY OWNER.)

      ALSO, IN ACCORDANCE WITH SECTION III D OF THIS SAME ORDINANCE, THE BOARD OF PUBLIC WORKS HEREBY ESTABLISHES AN ADDITIONAL MONTHLY COLLECTION CHARGE OF $6.00 PER TOTER FOR ALL TOTERS BEYOND THE FOUR (4) PROVIDED BY THIS ORDINANCE.

      THESE CHARGES WILL APPLY TO ALL AFFECTED BILLINGS STARTING AUGUST, 2010.

      ATTORNEY COPENHAVER SAID HE WANTED TO MAKE SURE EVERYONE AGREED ON THIS.   HE SAID, IF HE HAD A 3 UNIT APARTMENT, AND THAT 3 UNIT PAYS 3 WATER BILLS, THEY ARE ALREADY PAYING $36.00 FOR TRASH COLLECTION.  SO, EACH UNIT WOULD RECEIVE A BIG TOTER AND A SMALL TOTER.AT NO ADDITIONAL CHARGE.  SO, THIS DOESN'T MEAN IF I'M A LANDLORD AND OWN A 3 UNIT APARTMENT, THAT HAS OUT FRONT, 6 TOTERS, THAT I'M GOING TO PAY ANYMORE THAN THE $36.00 PER MONTH.  THIS WILL ONLY EFFECT IF I HAVE A SINGLE BILL AND I REQUEST THE ADDITIONAL 2 TOTERS.

      UTILITIES MANAGER PLUMMER SAID WHAT THEY WERE LOOKING AT WAS, IF YOU HAD A TRIPLEX, ACCORDING TO THE ORDINANCE, EVERY PROPERTY OWNER IS ENTITLED TO A 96 GALLON TOTER AND A 48 GALLON TOTER.  THE PROPOSED $6.00 CHARGE IS FOR ADDITIONAL

TOTERS.

     ATTORNEY COPENHAVER SAID THEN A TRIPLEX, WITH 3 METERS, IS ONLY BEING CHARGED $12.00 A MONTH. 

     MANAGER PLUMMER SAID YES.  IT PERTAINS TO THE PROPERTY ONLY, NOT METERS.

     ATTORNEY COPENHAVER SAID HE WANTED TO MAKE SURE THAT SOMEONE IS NOT PAYING $12.00 AND HAS ONLY 2 TOTERS AND IS PAYING MORE THAN THE $12.00.

     MANAGER PLUMMER SAID IN A DUPLEX, THERE IS A 96 AND 48 TOTERS ASSIGNED TO THAT DUPLEX.  IF THEY WANT AN ADDITIONAL TOTER, THEY WILL PAY AN ADDITIONAL $6.00.

     ATTORNEY COPENHAVER SAID, THEY AREN'T PAYING ANYMORE THAN $12.00 TO HAVE 2 TOTERS PICKED UP.

     MAYOR SMALL SAID THAT MR. PLUMMER5 DID SOME RESEARCH.  WE HAVE 338 DUPLEXES, 40 QUADS AND 78 NON-PROFITS THAT WILL BE EFFECTED BY THIS.  THE ADDITIONAL REVENUE THAT COULD BE BROUGHT IN BY THIS IS $112,000.00 PER YEAR IN REVENUE, APPROXIMATELY 10% OF WHAT WE ESTIMATED THE TOTAL COST OF TRASH COLLECTION.

      ATTORNEY COPENHAVER SAID HE SET IN MEETINGS AND THERE WERE SOME CONCERNS ABOUT RECYCLING.  THOSE THAT RECYCLE AND HAVE LESS TRASH, PAY THE SAME.  THIS TENDS TO EQUAL THIS OUT A LITTLE.  A FAMILY THAT RECYCLES PAYS $12.00 AND NEXT DOOR THERE IS A NON-FOR-PROFIT WITH 8 TOTERS, THEY ARE GOING TO PAY MORE FOR THOSE 8 TOTERS.

DEPARTMENT HEADS:

 

SUPERINTENDENT DENNY SAID THE CEMETERY SOIL SAMPLES HAVE BEEN TAKEN AND SENT.

WE ARE WAITING ON RESULTS SO WE CAN SELL SPACES.   THE CEMETERY COULD USE MORE GRASS CUTTERS.   
 

UTILITIES SUPERINTENDENT HAMILTON SAID CONSTRUCTION HAS STARTED ON THE PHASE 3 OF THE BLUE RIVER PROJECT.  HE SAID THERE WAS AN ISSUE ABOUT CATTLE BUT HE THOUGHT THE ISSUE HAD BEEN SOLVED.

 

ASST. STREET COMMISSIONER TICHENOR ANNOUNCED THAT THE 27TH AND D AVENUE PROJECT HAS BEEN COMPLETED AS OF TODAY.

 

ATTORNEY COPENHAVER SAID WHILE HE WAS ON VACATION, HE FOUND THERE IS BUDGET AND FINANCIAL PROBLEMS ALL OVER THE COUNTRY.

 

 

CITIZENS:

 

PASTOR JEFF JACOB, CHURCH OF THE SANCTUARY ON BROAD STREET, APPEARED BEFORE THE BOARD REQUESTING PERMISSION TO SET UP A TENT, PLAY MUSIC AND GIVE FREE WATER AND COLAS.  HE SAID THIS WAS GOING TO BE A YOUTH OUTREACH ON SATURDAY, AUGUST 21ST. AT BAKER PARK.

      THE BOARD OF WORKS SUGGESTED THAT PASTOR JACOB ATTEND THE PARK BOARD MEETING NEXT TUESDAY FOR THEIR APPROVAL.

      ATTORNEY COPENHAVER MADE THE MOTION TO APPROVE THE REQUEST SUBJECT TO APPROVAL BY THE NEW CASTLE PARK BOARD.     DIRECTOR DAVIS: SECOND                MAYOR SMALL: AYE                 AYE VOTE: 3-0
