Ordinance #3591 - Amending Ordinance #3088 / False Alarms
ORDINANCE NO. 3591
WHEREAS, the New Castle by passage of Ordinance No. 3088 on March 17, 1997, enacted a procedure to deal with automatic alarm systems, and
WHEREAS, that system imposes a penalty in the event of repeated false alarms, and
WHEREAS, said penalty if imposed does not reimburse the City of New Castle for the costs incurred in dealing with such false alarms and therefore should be increased.
IT IS THEREFORE ORDAINED BY THE COMMON COUNCIL OF THE CITY OF NEW CASTLE, INDIANA that Title 9, Chapter 93, Section 93.05(C) should be amended to provide for a fine of $150.00 in the event the owner fails to comply with the terms of the Ordinance, increasing that fine from its current level of $100.00.
All other provisions of Ordinance No. 3088, Section 93.05 of New Castle City Code shall remain in full force and effect.
REPEALER: All ordinances or parts of ordinances in conflict herewith are hereby repealed.
SEVERABILITY: Any provision herein contained which is found by a court of competent jurisdiction to be unlawful or which by operation shall be inapplicable, shall be deemed omitted but the rest and remainder of this ordinance, to the extent feasible, shall remain in full force and effect.
EFFECTIVE DATE: This Ordinance shall become effective immediately upon passage and publication as provided for by law.
