Ordinance #3565 - Surcharge for City Ordinance Violations

ORDINANCE NO.  3565 

AN ORDINANCE ADOPTING A CITATION SURCHARGE
FOR VIOLATIONS OF CITY ORDINANCES
 

 

     WHEREAS, the City of New Castle Police Department, Building Commissioners Office and Humane Officers on a daily basis are involved in enforcing City ordinances for violations, and

 

     WHEREAS, the City of New Castle Police and Building Commissioners Office, along with the contracted services of Humane officers are authorized to protect, and improve the health, safety and wellbeing of its citizens, and

 

     WHEREAS, the City of New Castle operates a City Court system as provided in I.C. 33-35-2, and

 

     WHEREAS, it is reasonable to impose these costs so that the taxpayers of the City of New Castle do not suffer a loss as a result of these duties and the use of City owned municipal vehicles and contractual payments.

 

     NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF NEW CASTLE, INDIANA that the City Court of the City of New Castle shall collect a twenty dollar ($20.00) fee to defray contractual costs, the costs of fuel, as well as the wear and tear of vehicles and equipment owned and operated by the City of New Castle, Indiana.  However, nothing herein shall give the Department or the Court authority to charge a fee for those violators that have been found not guilty.  Payments received shall be receipted and processed by the City Court Clerk with the surcharge being deposited into the General Account.

 

     IT IS FURTHER ORDAINED that it is the intent of the City of New Castle to conform to the provisions of Indiana Code as they currently exist and are amended by this Council.  Any provisions of this ordinance that is deemed in conflict with the aforementioned Indiana Code shall be deemed null and void and all other provisions of this ordinance not in conflict shall remain in full force and effect.

 

     REPEALER: All ordinances or parts of ordinances in conflict herewith are hereby repealed.

 

     SEVERABILITY: Any provision herein contained which is found by a court of competent jurisdiction to be unlawful or which by operation shall be inapplicable, shall be deemed omitted but the rest and remainder of this ordinance, to the extent feasible, shall remain in full force and effect.

 

     EFFECTIVE DATE: This Ordinance shall become effective immediately upon passage and publication as provided for by law.
