Ordinance #3679 - No Parking, Part of North 14th Street
ORDINANCE NO. _3679_
AN ORDINANCE AMENDING NEW CASTLE CITY CODE TITLE XII, CHAPTER 75, SCHEDULE I, ESTABLISHING AN ADDITIONAL NO-PARKING ZONE
WHEREAS, it is in the best interests of the citizens of the City of New Castle to establish certain no-parking zones in order to meet the needs of specific neighborhoods and protect the public health and safety; and,
WHEREAS, Schedule I of Chapter 75 of the New Castle City Code sets forth those no-parking zones.
NOW THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL of the City of New Castle, Indiana that Title XII, Chapter 75, Schedule I of the New Castle City Code shall be amended by adding the following no-parking zone:
1. STREET: North 14th Street
2. SIDE: East and West (both sides)
3. LOCATION: Commencing at the intersection of North 14th Street and Woodward Avenue on the South continuing North to the intersection of North 14th Street and North 16th (Indiana State Road 103). (See Exhibit "1" which is attached hereto and incorporated herein.)
4. PENALITY: Any violator of this ordinance shall be subject to a fine of not less than $50.00 nor greater than $200.00 to be determined by the Court and shall be further subject to all provisions of the New Castle City Code, Sections 72.40, 72.41, and 72.99(H). Further the violator shall be responsible for all costs incurred in towing and impoundment of the improperly parked vehicle and storage thereof. A separate offense shall be deemed committed on each day that a violation occurs or continues.
REPEALER: All ordinances or parts of ordinances in conflict herewith are hereby repealed.
SEVERABILITY: Any provision herein contained which is found by a court of competent jurisdiction to be unlawful or which by operation shall be inapplicable, shall be deemed omitted but the rest and remainder of this ordinance, to the extent feasible, shall remain in full force and effect.
EFFECTIVE DATE: This Ordinance shall become effective immediately upon passage and publication. Its enforcement may occur after the no parking signs referred to above are properly erected.
This ordinance is being enacted pursuant to the authority given the City of New Castle pursuant to I.C. 9-21-1-2 and 9-21-1-3(7).
