Ordinance #3599 - Amending City Code (Street signs)
ORDINANCE NO. ___3599_____________
WHEREAS, the intersection of 21st Street and F Avenue is currently controlled by stop signs on F Avenue, and
WHEREAS, it has been determined that it is the best interest of public safety that additional stop signs be installed at said intersection on 21st Street as it approaches F Avenue from the north or south, creating a four way stop at said intersection, and
WHEREAS, it has been determined that the intersection of 9th Street and Spring Street should be controlled by stop signs at all entrances to said intersection creating a four-way stop at said intersection.
WHEREAS, that a stop sign should be placed on East Fairoaks Drive at the point of its merger with Lynndale Avenue stopping northbound traffic on Fairoaks Drive,
1. Designation of stop streets.
NOW THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF NEW CASTLE that Chapter 74 Schedule 1 of the New Castle City Code is hereby amended by adding those streets where a stop sign should be located:
Street Location
21st Street North and south approach to F Avenue
Street Location
Spring Street East and west approaches to 9th Street
By adding these stop signs to the intersection of 9th Street and Spring Street, said intersection becomes a four-way stop with stop signs controlling all legal approaches to the intersection.

2. Penalty.
One who violates this ordinance shall be subject to the penalties set forth in Section 70.99 of the new Castle City Code and any violation shall be further reported to the Indiana Bureau of Motor Vehicles for the assessment of points and other penalties that may be applicable pursuant to State law.
3. Effective Date.
This ordinance shall be effective immediately upon passage and publication. Its enforcement may occur after the stop signs referred to above are properly erected pursuant to the provisions of Indiana's Manual on Uniform Traffic Control Devices for streets and highways.
This ordinance is being enacted pursuant to the authority given the City of New Castle pursuant to I.C. 9-21-1-2 and 9-21-1-3(7).
REPEALER: All ordinances or parts of ordinances in conflict herewith are hereby repealed.
SEVERABILITY: Any provision herein contained which is found by a court of competent jurisdiction to be unlawful or which by operation shall be inapplicable, shall be deemed omitted but the rest and remainder of this ordinance, to the extent feasible, shall remain in full force and effect.
EFFECTIVE DATE: This Ordinance shall become effective immediately upon passage and publication as provided for by law.
