ORDINANCE NO. _3678_
AN ORDINANCE AMENDING ORDINANCE NO. 3172
WHEREAS, the City of New Castle on October 5, 1998 adopted Ordinance 3172, which was an Ordinance Creating a Municipal Purchasing Agency in conformance with the current Purchasing Act of the State of Indiana; and,
WHEREAS, said Ordinance requires the City of New Castle to comply with all federal, state and local purchasing laws and regulations; and,
WHEREAS, from time to time the City may receive funds from the Federal Government in the form of grants, loans, and other sources; and,
WHEREAS, it is the intent and desire of the City to comply with all Federal regulations with regard to purchasing when such monies are utilized by the City of New Castle.
NOW THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL of the City of New Castle, that Ordinance 3172 is hereby amended as follows:
SECTION 8: When money is received from the Federal Government either through grants, project funds, loans or from any other source, the City of New Castle shall comply in all respects with any Federal purchasing laws or requirements or grant requirements associated with said funds in addition to the State requirements set forth hereinabove. It shall be the responsibility of the City of New Castle to meet all Federal regulations with regard to the use of Federal funds.
REPEALER: All ordinances or parts of ordinances in conflict herewith are hereby repealed.
SEVERABILITY: Any provision herein contained which is found by a court of competent jurisdiction to be unlawful or which by operation shall be inapplicable, shall be deemed omitted but the rest and remainder of this ordinance, to the extent feasible, shall remain in full force and effect.
EFFECTIVE DATE: This Ordinance shall become effective immediately upon passage.
